My bankruptcy is not discharged yet so should I apply for credit now or later?

Should I apply for credit now or after my bankruptcy is discharged? What should I apply for? credit cards or like a dell computer?

If you are in a chapter 7 bankruptcy you can apply for credit and incur additional debt the minute after the petition is filed with the court, you need no one's permission. If you are in a chapter 13 bankruptcy you must get permission from the court to incur additional debt.

  1. dont worry there like falcons as soon as the day of discharge hits they will start sending you offers.Problem is and I dont know your story but if you could not handle the debt once dont start doing it again.
    You will only end up there again !

  2. If you have a bankruptcy pending, you can't legally apply for ANY credit without permission from the bankruptcy court. If you fail to disclose the bankruptcy on any credit application, you are committing fraud.

  3. One other poster is almost right. If you have not yet received your discharge, you need the permission of the bankruptcy trustee (not the permission of the court) before you incur any new debt.

    If you cannot wait until after you receive your discharge, ask your attorney to help you ask the trustee for permission. If you need something like a computer (e.g.) for school, and you have the means to pay the amount due on the installment agreement, the trustee will usually grant such requests.

    With respect to credit cards: I'm not an attorney, but I don't believe that you need to ask the trustee's permission to apply for a credit card. You just need the trustee's permission to charge anything on it.
